Terms of Service
These terms set the rules of the road for using NowServe — your account, the build engagement, and the hosting we provide afterwards. Reading them takes about ten minutes; doing so once will save us both a longer conversation later.

1. Agreement
By creating an account at nowserve.coor using anything we deliver to you, you agree to these Terms of Service (the “Terms”). NowServe is a subsidiary product offered by Now Tech Inc. (“we,” “us,” or the “Company” — also referred to publicly as Now Tech). Background on our parent organization is published at nowtechinc.com. If you’re agreeing on behalf of a business, you confirm you have authority to bind that business to these Terms.
You must be at least 18 years old to open an account.
2. Your account
- You’re responsible for the security of your account credentials and for all activity under your account.
- One account per restaurant operator. You may run multiple restaurant projects from a single account.
- You must give us accurate information about your business during onboarding and keep it current.
3. The build engagement
When you commission a build, your project moves through a defined set of phases. We are responsible for moving it forward; you are responsible for providing accurate input and prompt approvals at the gates we’ll flag.
- Draft — you fill out the wizard and select a setup tier.
- Awaiting deposit verification — you submit the 30% deposit by bank transfer; we verify receipt.
- Planning — we scope your project and align on direction.
- Designing — design work begins; this is when our committed effort becomes substantial.
- Developing — engineering builds out your site and menu.
- Preview pending final payment — we share a preview URL; you review.
- Awaiting final payment verification — you mark final payment sent; we verify.
- Complete — we hand off, hosting (if selected) goes live, and your QR codes are activated.
A project may also enter a needs owner actionstate if we’re blocked on something only you can provide (a missing asset, a clarification, a payment).
4. Setup tiers and pricing
Setup is a one-time fee tied to a tier you choose during onboarding:
- Starter — clean responsive website, three custom pages, SEO foundation, mobile optimization.
- Plus — everything in Starter, dynamic QR menu system, custom table tents, five custom pages, photo gallery setup.
- Pro — everything in Plus, custom animations, advanced analytics dashboard, direct reservation integration, priority build queue.
Prices shown on our pricing pages are listed in US dollars and are confirmed during onboarding. Setup is invoiced as a 30% deposit at kickoff and the remaining 70% on preview. Both transfers are made by bank transfer to the account we share inside the dashboard.
5. Hosting service
After build, you choose how to host:
- Self-Hosted — we deliver the source code and a basic deployment guide. You manage your own infrastructure from there.
- Essential Hosting — we host on a global CDN, target 99.9% uptime, manage SSL and automated backups.
- Growth Partner — Essential plus priority email support and two hours of development changes per year.
- Concierge — Growth Partner plus direct phone/text support and ten hours of development changes per year.
Paid hosting plans renew annually unless cancelled. The 99.9% uptime figure is a target and operational goal — it is not a service-level guarantee with credits unless we agree to one in writing. We may schedule planned maintenance windows; we will give reasonable notice for anything that affects availability.
6. Payments
- Setup deposits and final payments are made by bank transfer using the instructions snapshot stored against your project.
- Annual hosting payments are processed by Stripe.
- You’re responsible for any taxes that apply on your end. We’ll add VAT or sales tax to invoices where required by law.
- If a payment fails or is reversed, we may pause work or suspend hosting until it’s resolved.
7. Refunds
Refunds are governed by our Refund Policy, which is part of these Terms. The short version: deposits are refundable up to the moment substantial design work begins, hosting is pro-rata refundable minus a small admin fee, and self-hosted code deliverables are non-refundable once delivered.
8. Your content
Anything you upload — logos, menu PDFs, photography, item descriptions, prices, brand kits — remains yours. By using NowServe you grant us a non-exclusive, worldwide license to host, copy, transform (for example, optimize for the web), and display that content for the purpose of delivering the service to you. The license ends when you delete the content or close your account, except for backup copies we may retain for a reasonable period.
You confirm you have the rights to everything you upload and that it doesn’t infringe anyone else’s rights or break the law.
9. Our content
The NowServe platform — the dashboard, design system, admin tooling, our analytics script delivered at/integrations/nowserve-analytics.js, and our underlying source code — belongs to Now Tech Inc. We grant you a license to use it as part of the service. We do not license you to resell, sublicense, white-label, or reverse-engineer the platform itself.
When you take a Self-Hosted delivery, the code we generate for your specific website and menu is yours to use, host, and modify. Shared platform components (e.g. the analytics ingest endpoint) remain operated by us and are subject to these Terms.
10. Acceptable use
You agree not to use NowServe to:
- Sell goods that are illegal in your jurisdiction (controlled substances, illegal wildlife, weapons, etc.).
- Impersonate another business or person.
- Upload malware, executables, or content that violates our upload policy. We accept the file types listed in our upload guide; everything else is rejected at the door.
- Attempt to circumvent, disable, or overwhelm our rate limits, authentication, or storage controls.
- Scrape, clone, or systematically copy other restaurants’ menus hosted on NowServe.
- Use the service to send spam or unsolicited marketing.
We may remove specific content or suspend access for activity that violates this section while we investigate.
11. Suspension and termination
- You may cancel your account at any time from the dashboard or by emailing support@nowserve.co.
- We may suspend or terminate your account for material breach of these Terms, fraud, or non-payment. Where reasonable, we’ll give you a chance to cure the issue first.
- We may ban an account for serious or repeated abuse and record the reason for the record.
- On termination, you can request an export of your menu and brand assets within 60 days. After that, we may delete your data per the Privacy Policy.
12. Disclaimers
NowServe is provided “as is.” While we work hard to make the service reliable, fast, and accurate, we don’t promise it will be uninterrupted, error-free, or fit for every purpose you imagine. To the maximum extent permitted by law, we disclaim all implied warranties.
We’re a tooling and services partner — not your accountant, lawyer, or food-safety consultant. Don’t rely on us for advice in those areas.
13. Limitation of liability
To the maximum extent permitted by law, NowServe’s total liability to you for any claim arising out of or related to these Terms or the service is limited to the amount you actually paid us in the 12 months before the event giving rise to the claim. We’re not liable for indirect, consequential, special, incidental, or exemplary damages, including lost profits, lost revenue, or lost data.
14. Indemnity
You agree to defend and indemnify Now Tech Inc. against third-party claims arising from content you uploaded, your violation of these Terms, or your violation of applicable law.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with a new “Last updated” date and, where appropriate, sent to you by email before they take effect. Continuing to use NowServe after a change means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules. You consent to the exclusive jurisdiction of the state and federal courts located in New York County, New York, unless applicable consumer-protection law in your jurisdiction gives you a non-waivable right to sue or be sued elsewhere.
